  1. ROLE OF GASCHERRY SAFARIS
    The role of Gascherry Safaris is to make arrangements for safari tours and travel itineraries to fit the requirements of our customers. The following terms, as used in these Booking Terms and Conditions, shall be considered to refer to the travel arrangements being booked with Gascherry Safaris. In doing so, we may use independent suppliers for the provision of selected services. Whatever the case, we accept responsibility for the proper performance of your contract with us subject to the following booking conditions.

  2. PRICES AND CURRENCY FLUCTUATION
    Published prices are based on costs at the time of publication. We reserve the right to change published prices at any time before your booking is made. As currencies do fluctuate, we do not build into price an allowance to cover possible increases from currency fluctuations. Therefore, it may be necessary for us to raise the tour cost at any time before final payment if there are exceptional cost increases beyond our control. An increase in the price shall not be sufficient grounds for any refund of fees already paid for the tour.

  3. GOVERNMENT TAXES
    Any increase in government taxes affecting costs included in the tour price will be passed through and paid for by the traveler. Any increase in the tour price due to a government tax rate hike shall not be sufficient grounds for any refund of fees already paid for the tour.

  4. AIRFARES & DELAYS
    Airfares are subject to change without notice prior to ticketing. Note that intra-Africa airfares, whether included in your total trip cost or quoted to you separately, may become due and payable in full to Gascherry Safaris at any time after your initial deposit in order for us to secure ticketing for these flights as required by the airline. Gascherry Safaris is not responsible for any airline schedule or airfare changes, cancellations, overbooking or damage or loss of luggage and property to the extent that such items are beyond its control. Any and all claims for any loss or injury suffered on any airline must be made directly with the airline involved and not Gascherry Safaris. Air schedule changes may necessitate additional nights being added to your tour. Provided these schedule changes are beyond the control of Gascherry Safaris, any resulting additional cost must be borne by the guest. Gascherry Safaris cannot be held liable for any delays or additional costs incurred as a result of airlines not running to schedule.
    All outward or homeward points of departure should be read in relation to the services which we have been contracted to provide and not any flight or other travel arrangement which may have been added on.

  5. LUGGAGE
    For safety and because space is restricted, baggage in the charter aircraft commonly used to transport guests to and from camps is restricted to a maximum of 20 kg per person; international flights allowance per person is 23 kg.

    Safari luggage is strictly limited due to the nature of the tour, to one large bag weighing a maximum of 15 kg, plus hand-luggage and a camera bag per client. To avoid transport problems, extra luggage can always be stored until the end of your safari tour.

  6. RESERVATIONS AND PAYMENTS
    A binding contract between you and Gascherry Safaris only exists when we have accepted your booking by issuing an invoice and a deposit has been paid by you. The deposit of 30% of the invoice must be paid on receiving our invoice, after which a signed response is required on whether to confirm your reservation. The balance of the safari price is due not less than 4 weeks before commencement of our services (unless otherwise specified and agreed in the Clients Contract). No client will be permitted to commence any itinerary without payment in full being received by the Company. If payment is not made by the due date, we reserve the right to treat the booking as having been cancelled by you, and apply cancellation charges as set out in paragraph 7(a) below.
    Late applicants may join the tour based on accommodation availability.

  7. CANCELLATION AND REFUND POLICY
    (a) By you
    Gascherry Safaris must be notified of cancellations in writing by the client. If cancellation is made prior to 8 weeks before departure, 10% of the total fare rate is non-refundable. If your cancellation is made after the due date for full payment of your safari fare, additional charges will apply. The scale of charges, expressed as a percentage of the safari fare price, is as follows:

    • More than 8 weeks notice before departure: 10% of the total fare rate non-refundable.
    • Less than 6 weeks notice: a cancellation fee of 30% of the total fare rate will apply.
    • If notification is received less than 3 weeks: 50% of the total fare rate will apply.
    • If notification is received in less than 2 weeks: 75% of the total fare rate will apply.
    • If notification is received less than 1 week before departure: the cancellation fee payable is 100% of the safari total price rate.

    Should you fail to join a tour, join it after departure, or leave it prior to its completion, no tour fare refund will be made. Some airfare may be non-refundable. There will be no refunds from Gascherry Safaris for any unused portions of the tour. The above policy applies to all travel arrangements made via Gascherry Safaris.

    (b) Guest Representation
    The person making any booking with Gascherry Safaris warrants that he or she has authority to enter into a contract on behalf of all other persons included in such a booking, and in the event of the failure of any or all of the other persons so included to make payment, or if an arrangement is cancelled because an insufficient number of people have booked a scheduled tour, the person making the booking shall, by his/her signature thereof, assume personal liability for the total price of all bookings made by him or her.
    The payment of the deposit or any other partial payment for a reservation on a tour constitutes consent by all guests covered by that payment to all the Terms and Conditions contained herein, whether the guest has signed the booking form or not. The terms, under which you agree to take these tours, cannot be changed or amended except in writing signed by an authorized representative of Gascherry Safaris.

  8. ALTERATIONS AND ITINERARY CHANGES
    (a)
    While doing our utmost to avoid it, we must reserve the right to cancel arrangements. If this should happen (other than due to your default in paying), Gascherry Safaris will not be held responsible for occurrences that are beyond its control, force majeure such as: strikes, threat of war, acts of government, or any other cause whatsoever beyond its control that may make the operation of the tour impossible, illegal, or inadvisable. We will offer the choice of an alternative arrangement (paying or receiving a refund in respect of any price difference) or receiving a full refund. If we are forced to curtail a tour after departure due to circumstances amounting to “force majeure”, we regret we cannot make any refunds or pay any compensation or be responsible for any costs or expenses incurred by you as a result.

    (b)
    Although every effort is made not to change the schedules, it should be noted that occasionally we are obliged to change routes and camps on safari as dictated by changing conditions, seasonal rainfall, bush fires, or other natural occurrences. Airlines, aircraft, specific flights, and other transfers may also be changed for various reasons. We reserve the right to make changes to brochure details and holiday arrangements both before and after your booking is made. Most changes will be minor. If we have to make significant changes to an arrangement, you will be notified at the earliest possible opportunity. In such cases, you will have the choice of either accepting the change or booking alternative arrangements. Gascherry Safaris shall not be responsible for such itinerary changes as discussed above and shall not be held liable for any refund, provided such changes are beyond the control of Gascherry Safaris.

    (c)
    In the unlikely event of a vehicle breakdown that is beyond the Company’s control and immediate repair, the Company will arrange to have as fast as possible the vehicle repaired or arrange for a change of vehicle. The Company reserves the right to alter the itinerary accordingly in order to make up any time lost due to any unforeseen circumstances.

    (d)
    The Company reserves the right to cancel the tour without prior notification and, in such an event, only agrees to refund all the money already paid and received from the Client.

  9. FORCE MAJEURE
    “Force Majeure” means those circumstances where the performance of our contract with you is prevented or affected by reasons of war, threat of war, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental actions, and all similar events beyond our control. In these circumstances, we shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses you might incur where we are forced as a result to cancel, delay, curtail, or change your arrangement in any way or where the performance or prompt performance of our contractual obligations is prevented or affected.

  10. WILD ANIMALS
    Please note that our safaris may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. Prior to your departure for your safari you will be briefed on the do’s and don’ts while on safari. Always follow the safety instructions of the camp’s staff with regards to moving to and from your tent and while on game activities throughout your safari. Gascherry Safaris cannot be held responsible for injury or incident on the safari.

  11. GAME VIEWING
    No guarantees are given for sightings of specific species of wildlife or for what may be considered “good or poor game viewing”, as the animals inhabiting the areas you will visit are wild and therefore behave as such. Gascherry Safaris cannot be held responsible in any way for the presence or lack thereof of wildlife numbers, nor for the quality of game viewing on your safari.

  12. PASSPORTS AND VISAS
    (a)
    The guest must ensure that passports and visas are valid for the countries they plan to visit. Please consult the Embassy of the country you are planning to visit or contact us for more information. Gascherry Safaris cannot be held liable for any visas and passports that are invalid or not held by the guests, nor for the cost of any passports or visas.

    (b) Client Responsibility
    It is the Client’s responsibility to meet any additional costs incurred either by the Client (or by the Company on the Client’s behalf) as a result of any failure by the Client to comply with such requirements. The Company will not be held liable for any failure of the Client not being in possession of the correct travel documents.

    (c)
    It is the Client’s responsibility to check the latest information from the appropriate government sources (such as the Foreign and Commonwealth Office) for the countries they will be traveling to.

  13. INSURANCE
    (a)
    Travel and cancellation insurance is mandatory for every Client. All insurance is solely the responsibility of the Client. Before a Client commences a tour, he/she should arrange his/her own insurance with protection for the full duration of the travel, to cover, including but not limited to, personal injury, damage and loss of personal items (including camera equipment and other electronics), medical expenses, repatriation expenses, and loss of luggage. If a Client falls ill, all hospital expenses, medical expenses, doctor’s fees, repatriation costs, or any other cost which may occur, are the Client’s responsibility and the Company shall not be liable for any refund of the tour fare.

    (b)
    The carriage and storage of all baggage and personal effects are at all times the Client’s risk, and the Company will not accept any liability for any loss or damage of baggage or personal effects. It is the Client’s responsibility to ensure all personal items are covered by travel insurance.

  14. LIABILITY
    (a)
    The Client hereby acknowledges, confirms, and records that he/she understands the risk inherent in adventure travel in African destinations and associated activities. Upon the payment of the advance deposit by the Client, the Client accepts the tour and undertakes to do the tour, travel, or activity at his/her own risk. The Client agrees and concedes that the Company, its representatives, and employees shall not be responsible for loss or damage to possessions, or injury or illness to the Client, or loss of life or consequential damages which might occur from any cause whatsoever, unless directly caused by the Company’s negligence.

    (b) Health and Medical Information
    Participation on a safari tour requires that you be in generally good health, while a measure of physical activity is involved in all African safaris and tours. The Client shall acknowledge an awareness of the proposed itinerary and shall confirm that he/she is medically fit and is able to embark on the tour. It is essential that Clients with any pre-existing medical condition or illness, or related dietary restrictions, must declare the nature of such conditions to the Company before commencement of the tour.

    (c)
    Any required vaccinations must be recorded by the Client’s health practitioner on a valid vaccination certificate, which the Client must carry in his/her possession throughout the tour. The Company will not be responsible for the accuracy of any medical information. The Client should consult their doctor for up-to-date requirements and personal recommendations.

    (d) General
    Please note, our responsibilities and obligations apply only in respect of those services which we agree to arrange or provide on your behalf. We cannot accept any liability for any services which you arrange on your own.

    (e)
    The Company’s liability to Tourists carried by safari vehicles for the transfers, excursions, safaris, or tours is governed by the law of Kenya (Ministry of Tourism Kenya) and all claims are subject to the courts of Kenya.

  15. COMPLAINTS
    Should a problem occur, please advise both Gascherry Safaris and the supplier of the service in question immediately, as most problems are resolved most easily on the spot. Should you remain dissatisfied, please write to us setting out the complaint in detail within 28 days of the end of our services under the contract. We cannot accept responsibility for any complaints which are not notified entirely in accordance with this clause.

  16. GENERAL INFORMATION
    (a) Accommodation
    Wherever possible, we book rooms on the basis of two people sharing a double room, or single rooms. Where mentioned in the brochure, hotels/lodges/camps are named as an indication of category and we may book rooms at similar hotels/lodges/camps.

    (b) Transportation
    Safaris are conducted using Toyota minibuses, cars, Toyota Land Cruiser 4×4s, coaches, or aircraft. We reserve the right to employ the services of sub-contractors.

    (c) Special Requests
    Any special requests must be notified in writing when the booking is made. We will put all our effort into meeting such requests but cannot guarantee them. If any accommodation or excursion is unavailable, a reasonable alternative acceptable to the Client will be found; any failure to comply will not be considered a breach of the contract.

  17. COMPANY RESPONSIBILITY AND RIGHTS
    The information in any brochure and printed itineraries is given based on the latest information available to the Company. Printed itineraries serve as a guideline only. The Company reserves the right to change the facilities or transport described in any publication without being liable for any compensation or refund.

  18. MEDIA
    The pictures on this website can be used for social media purposes.

  19. THE COMPANY AUTHORITY
    (a)
    Any decision made by the tour guide, acting as a Company representative, shall be deemed final on all matters. The Company shall not be responsible or liable for any client who commits an illegal or unlawful act in any country visited, or for the consequences of such an illegal act. In such circumstances, the Client may be excluded from the tour without a refund. If the Client causes severe inconvenience or implied danger to any other Clients or Company representatives, the Company may decline to carry the Client further and exclude the Client from the tour without refund. This will only occur after extensive intervention by the tour guide or Company representative.

    (b) Printing
    Gascherry Safaris does not accept responsibility for possible printing errors.
